Terms of Use

1. Parties and Acceptance of Agreement

This Terms of Use Agreement ("Agreement") governs the terms of use for all services (application, website, infrastructure) provided by the MinglePub brand and platform ("Platform", "MinglePub"). By registering, logging in, or accessing any content on the Platform, you irrevocably accept all terms in this Agreement. If you do not agree to any of the terms, you must immediately remove the Platform from your device and discontinue use.

2. Eligibility and Age Restriction (18+)

MinglePub is STRICTLY AND EXCLUSIVELY intended for adult users aged 18 AND OVER. By using the Platform, you represent and warrant that you are at least 18 years of age and are considered of legal age under the laws of your country of residence. It is strictly prohibited for individuals under 18 to register for, access, or use MinglePub services. Accounts found in violation will be immediately terminated.

3. Account Rules and Security

• Users are obligated to provide accurate and complete information (phone number, language, etc.) requested during the registration process.
• Your account is entirely personal. You may not rent, transfer, buy, or sell your account or in-app assets (diamonds, tokens, packages, etc.) to third parties.
• MinglePub assumes that the person who opened the account is responsible for all actions performed through their account. The security of passwords and verification codes is entirely your responsibility.

4. Strict Violation Rules ("Zero Tolerance Policy")

MinglePub aims to provide its users with a safe chatting environment. In the event of violations of the following rules, accounts will be permanently closed without prior warning or suspension. Balance and VIP membership fees will not be refunded:

• Nudity and Sexual Content Prohibition: MinglePub is NOT an adult content or sexual partner-finding platform. Any form of nudity, sexual acts, exhibitionism, making sexual propositions, and sexual harassment on camera is STRICTLY prohibited.
• Violence, Hate Speech, and Bullying: Verbally or physically threatening users, bullying, or committing hate crimes based on race, religion, language, sexual orientation, etc.
• Illegal Substance Use: Promotion, sale, or use of illegal drugs or stimulants in video chats or profile content.
• Unsolicited Commerce (Spam): Pyramid schemes, OnlyFans account promotion, cryptocurrency fraud, or general advertising/commercial link sharing.
• Child Exploitation Detection: Any action that endangers children or minors is directly reported to international law enforcement (NCMEC, etc.) along with IP and device information.

The Platform detects these violations through AI-powered video moderation and the Community Reporting System. MinglePub reserves the right to report violators to legal authorities when necessary.

5. User-Generated Content (UGC)

Ownership of content you upload to the Platform (profile photo, bio text, etc.) remains with you. However, you grant MinglePub a worldwide, royalty-free, and sub-licensable license to use this content for the application to function and for services to be provided to other users. You may not upload content that infringes on the copyrights, privacy, or trademark rights of others.

6. Legal Status of Independent Broadcasters (Hosts)

Certain "Verified" or professional users on the Platform ("Broadcasters", "Hosts") are NOT employees, personnel, agents, legal representatives, or subcontractors of the Platform.

• Broadcasters (Hosts) are entirely Independent Contractors (Freelancers) who independently use the MinglePub infrastructure during their own free time, with their own devices and internet connections.
• MinglePub is solely a technological platform that provides intermediary services (hosting provider) between the Broadcaster and the User. The actions and statements made by Broadcasters on their own initiative do not reflect the official views of the platform or the company.
• Broadcasters must also strictly comply with all platform rules, including the Nudity and Sexual Content Prohibition in Section 4. Legal responsibility arising from Hosts' off-platform interactions or rule violations belongs entirely to themselves, and MinglePub cannot be held legally responsible.

7. In-App Purchases, Virtual Balances, and Refund Policy

Users can purchase virtual currencies such as "Diamonds" and "Tokens" or "VIP Membership" packages from the in-app store.

• Virtual currencies (diamonds, tokens) have no real-world monetary value. They cannot be exchanged, sold, or converted to cash outside the Platform.
• Final Sale and No Refunds: All purchases made through the application are final and non-reversible. MinglePub does not provide direct cash refunds outside of Apple App Store's or Google Play Store's own consumer refund policies.
• In the event of permanent closure of your account due to violation of Terms of Use, your existing balances, diamonds, and VIP membership days will be reset, and you may not claim any monetary compensation.

8. App Store and Google Play Disclaimer

If you download the application through the Apple App Store or Google Play Store ('App Stores'), you acknowledge that this Agreement is solely between you and MinglePub; and that the App Stores are not responsible for the application's content, maintenance, or support services.

9. Disclaimer of Warranty and Limitation of Liability

The Platform provides its services "as is" and "as available." No guarantee of uninterrupted, virus-free, error-free, or completely secure connection (including internet service provider disconnections) is provided. MinglePub does not verify the behavior, history, or identity of other users you match with. MinglePub cannot be held responsible for any physical, material, or moral damage arising from conversations users have on the platform, personal information they share with each other, or their decision to meet physically off-platform. Your safety with the people you interact with is your responsibility.

10. Dispute Resolution and Jurisdiction

In the interpretation and application of this Agreement, the Laws of the country/business center where MinglePub's legal entity is officially registered shall apply to any disputes that may arise. The relevant competent courts, mediators, and enforcement offices shall have jurisdiction in case of any disputes.

11. Changes and Contact

MinglePub reserves the right to change the terms of this Agreement at any time without prior notice. Changes may result from system architecture, new features, or legal requirements. The current version of the Agreement takes effect upon being uploaded to the platform, and your continued use of the Platform means you have automatically read and accepted the changes.
