1. 當事人及協議的接受

本使用條款協議（「協議」）管轄 MinglePub 品牌和平台（「平台」、「MinglePub」）提供的所有服務（應用程式、網站、基礎設施）的使用條款。透過註冊、登入或存取平台上的任何內容，您不可撤銷地接受本協議中的所有條款。如果您不同意任何條款，您必須立即從您的裝置中刪除平台並停止使用。

2. 資格和年齡限制（18 歲以上）

MinglePub 嚴格且專門針對 18 歲及以上的成人使用者。使用本平台即表示您聲明並保證您已年滿 18 歲，並且根據您居住國的法律被視為達到法定年齡。嚴格禁止 18 歲以下的個人註冊、存取或使用 MinglePub 服務。發現違規的帳戶將立即被終止。

3. 帳戶規則及安全

  • 使用者有義務提供註冊過程中要求的準確、完整的資訊（電話號碼、語言等）。
  • 您的帳戶完全是個人的。您不得向第三方出租、轉讓、購買或出售您的帳戶或應用程式內資產（鑽石、代幣、禮包等）。
  • MinglePub 假定開設帳戶的人對透過其帳戶執行的所有操作負責。密碼和驗證碼的安全完全由您負責。
  • In addition to the specific violations listed in Section 4, MinglePub reserves the right to suspend or terminate any account at its sole discretion, with or without stated cause, and with or without prior notice.

4. 嚴格違規規則（「零容忍政策」）

MinglePub 旨在為使用者提供一個安全的聊天環境。如果違反以下規則，帳戶將永久關閉，恕不另行警告或暫停。餘額和 VIP 會員費將不予退還：

  • 裸露和色情內容禁止:MinglePub 不是成人內容或尋找性伴侶的平台。嚴格禁止在鏡頭前出現任何形式的裸體、性行為、暴露癖、性挑釁和性騷擾。
  • 暴力、仇恨言論與霸凌:基於種族、宗教、語言、性取向等對使用者進行口頭或身體威脅、霸凌或實施仇恨犯罪。
  • 非法藥物使用:在視訊聊天或個人資料內容中宣傳、銷售或使用非法藥物或興奮劑。
  • 未經請求的商業（垃圾郵件）:傳銷、OnlyFans 帳戶促銷、加密貨幣詐欺或一般廣告/商業連結分享。
  • 兒童剝削檢測:任何危及兒童或未成年人的行為都會連同 IP 和設備資訊直接報告給國際執法機構（NCMEC 等）。
  • Off-Platform Contact and Circumvention: Requesting a User's or Broadcaster's phone number, Telegram, WhatsApp, or any other means of contacting them outside the Platform — or sharing your own — is strictly prohibited. Violations are detected automatically and through the Community Reporting System, and result in immediate, permanent account closure without prior warning.
  • Not a Dating or Matchmaking Service: MinglePub is not a dating, matchmaking, or introduction service. Attempting to arrange, request, or facilitate an in-person meeting with another User or Broadcaster through the Platform is strictly prohibited and will result in immediate, permanent account closure.
  • Unauthorized Recording: Recording, screen-capturing, or otherwise storing the video, audio, or images of another User or Broadcaster without their explicit consent is strictly prohibited.

5. 使用者生成內容（UGC）

您上傳到平台的內容（個人資料照片、個人簡介等）的所有權仍歸您所有。但是，您授予 MinglePub 全球範圍內、免版稅且可再授權的許可，以使用此內容來執行應用程式以及向其他使用者提供服務。您不得上傳侵害他人版權、隱私或商標權的內容。

All intellectual property rights in the Platform itself — including its software, source code, design, trademarks, logos, and the MinglePub name — belong exclusively to MinglePub and/or its licensors. Nothing in this Agreement transfers any such rights to you.

6. 獨立廣播機構（主持人）的法律地位

平台上的某些「經過驗證」或專業使用者（「廣播者」、「主持人」）不是平台的員工、人員、代理人、法律代表或分包商。

  • 廣播公司（主持人）完全是獨立承包商（自由工作者），他們在空閒時間獨立使用 MinglePub 基礎設施，並擁有自己的設備和網路連線。
  • MinglePub 只是一個在廣播公司和使用者之間提供中介服務（託管提供者）的技術平台。主播自行做出的行為和聲明並不反映平台或公司的官方觀點。
  • 主播也必須嚴格遵守所有平台規則，包括第4條的裸露和色情內容禁止。主播平台外互動或違反規則所產生的法律責任完全由主播承擔，MinglePub 不負法律責任。
  • Recording or otherwise capturing a Broadcaster's on-platform performance for any purpose beyond normal use of the Platform requires the Broadcaster's separate, explicit consent.

7. 應用程式內購買、虛擬餘額和退款政策

用戶可以從應用程式內商店購買「鑽石」、「代幣」等虛擬貨幣或「VIP會員」套餐。

  • 虛擬貨幣（鑽石、代幣）沒有現實世界的貨幣價值。它們不能在平台外交換、出售或轉換為現金。
  • 最終銷售且不退款:透過應用程式進行的所有購買都是最終且不可逆轉的。 MinglePub 不提供 Apple App Store 或 Google Play Store 自己的消費者退款政策以外的直接現金退款。
  • 如果您的帳戶因違反使用條款而永久關閉，您現有的餘額、鑽石和VIP會員天數將被重置，並且您不得要求任何金錢賠償。
  • Payment Processing via Whop: Purchases made through our website are processed by Whop, Inc., an independent third-party payment processor. By completing such a purchase, you also agree to Whop's own Terms of Service and Privacy Policy, which govern the payment transaction itself.
  • Chargebacks and Payment Disputes: If you initiate a chargeback or payment dispute with your bank or payment provider without first contacting MinglePub support, your account may be immediately suspended pending investigation. MinglePub may submit evidence of your account activity to the payment processor or your bank to contest the dispute.
  • Pricing Changes: MinglePub reserves the right to change the pricing of virtual currencies, packages, or VIP membership plans at any time. Material pricing changes will be announced in-app before taking effect and will not retroactively affect balances you already own.

8. App Store 和 Google Play 免責聲明

如果您透過 Apple App Store 或 Google Play Store（「App Stores」）下載應用程式，則您承認本協議僅在您和 MinglePub 之間生效；並且應用程式商店不對應用程式的內容、維護或支援服務負責。

9. 免責聲明和責任限制

該平台「按原樣」和「可用」提供其服務。不保證連線不間斷、無病毒、無錯誤或完全安全（包括網路服務供應商斷開連線）。 MinglePub 不會驗證與您相符的其他使用者的行為、歷史記錄或身分。 MinglePub 對使用者在平台上的對話、彼此分享的個人資訊或決定在平台外見面而造成的任何身體、物質或精神損害不承擔任何責任。您對與您交往的人的安全負有責任。

10. 爭議解決和管轄

本協議的解釋和適用中可能產生的任何爭議，適用MinglePub法人正式註冊地國家/商務中心的法律。發生任何爭議時，相關主管法院、調解員和執行機構具有管轄權。

AI Live Translation

Calls between members who speak different languages may use real-time AI voice translation powered by third-party AI services (Google Gemini). Translations are generated automatically and may contain errors or inaccuracies; MinglePub does not guarantee the accuracy of any translation and is not liable for misunderstandings arising from translated content. By using the translation feature you agree that your call audio is processed by the third-party AI service as described in our Privacy Policy. You may disable translation at any time during a call.

11. 變更及聯繫

MinglePub 保留隨時更改本協議條款的權利，恕不另行通知。系統架構、新功能或法律要求可能會導致變更。目前版本的協議一經上傳至平台即生效，您繼續使用平台即表示您已自動閱讀並接受變更內容。
