1. 当事人及协议的接受

本使用条款协议（“协议”）管辖 MinglePub 品牌和平台（“平台”、“MinglePub”）提供的所有服务（应用程序、网站、基础设施）的使用条款。通过注册、登录或访问平台上的任何内容，您不可撤销地接受本协议中的所有条款。如果您不同意任何条款，您必须立即从您的设备中删除平台并停止使用。

2. 资格和年龄限制（18 岁以上）

MinglePub 严格且专门针对 18 岁及以上的成人用户。使用本平台即表示您声明并保证您已年满 18 岁，并且根据您居住国的法律被视为达到法定年龄。严格禁止 18 岁以下的个人注册、访问或使用 MinglePub 服务。发现违规的账户将立即被终止。

3. 账户规则及安全

  • 用户有义务提供注册过程中要求的准确、完整的信息（电话号码、语言等）。
  • 您的账户完全是个人的。您不得向第三方出租、转让、购买或出售您的账户或应用内资产（钻石、代币、礼包等）到第三方。
  • MinglePub 假定开设账户的人对通过其账户执行的所有操作负责。密码和验证码的安全完全由您负责。
  • In addition to the specific violations listed in Section 4, MinglePub reserves the right to suspend or terminate any account at its sole discretion, with or without stated cause, and with or without prior notice.

4. 严格违规规则（“零容忍政策”）

MinglePub 旨在为用户提供一个安全的聊天环境。如果违反以下规则，账户将被永久关闭，恕不另行警告或暂停。余额和 VIP 会员费将不予退还：

  • 裸露和色情内容禁止:MinglePub 不是成人内容或寻找性伴侣的平台。严格禁止在镜头前出现任何形式的裸体、性行为、暴露癖、性挑衅和性骚扰。
  • 暴力、仇恨言论和欺凌:基于种族、宗教、语言、性取向等对用户进行口头或身体威胁、欺凌或实施仇恨犯罪。
  • 非法药物使用:在视频聊天或个人资料内容中宣传、销售或使用非法药物或兴奋剂。
  • 未经请求的商业（垃圾邮件）:传销、OnlyFans 账户促销、加密货币欺诈或一般广告/商业链接共享。
  • 儿童剥削检测:任何危及儿童或未成年人的行为都会连同 IP 和设备信息直接报告给国际执法机构（NCMEC 等）。
  • Off-Platform Contact and Circumvention: Requesting a User's or Broadcaster's phone number, Telegram, WhatsApp, or any other means of contacting them outside the Platform — or sharing your own — is strictly prohibited. Violations are detected automatically and through the Community Reporting System, and result in immediate, permanent account closure without prior warning.
  • Not a Dating or Matchmaking Service: MinglePub is not a dating, matchmaking, or introduction service. Attempting to arrange, request, or facilitate an in-person meeting with another User or Broadcaster through the Platform is strictly prohibited and will result in immediate, permanent account closure.
  • Unauthorized Recording: Recording, screen-capturing, or otherwise storing the video, audio, or images of another User or Broadcaster without their explicit consent is strictly prohibited.

5. 用户生成内容 (UGC)

您上传到平台的内容（个人资料照片、个人简介文本等）的所有权仍归您所有。但是，您授予 MinglePub 全球范围内、免版税且可再许可的许可，以使用此内容来运行应用程序以及向其他用户提供服务。您不得上传侵犯他人版权、隐私或商标权的内容。

All intellectual property rights in the Platform itself — including its software, source code, design, trademarks, logos, and the MinglePub name — belong exclusively to MinglePub and/or its licensors. Nothing in this Agreement transfers any such rights to you.

6. 独立广播机构（主持人）的法律地位

平台上的某些“经过验证”或专业用户（“广播者”、“主持人”）不是平台的员工、人员、代理人、法律代表或分包商。

  • 广播公司（主持人）完全是独立承包商（自由职业者），他们在空闲时间独立使用 MinglePub 基础设施，拥有自己的设备和互联网连接。
  • MinglePub 只是一个在广播公司和用户之间提供中介服务（托管提供商）的技术平台。主播自行做出的行为和声明并不反映平台或公司的官方观点。
  • 主播还必须严格遵守所有平台规则，包括第 4 条中的裸露和色情内容禁止。主播平台外互动或违反规则所产生的法律责任完全由主播承担，MinglePub 不承担法律责任。
  • Recording or otherwise capturing a Broadcaster's on-platform performance for any purpose beyond normal use of the Platform requires the Broadcaster's separate, explicit consent.

7. 应用内购买、虚拟余额和退款政策

用户可以从应用内商店购买“钻石”、“代币”等虚拟货币或“VIP 会员”套餐。

  • 虚拟货币（钻石、代币）没有现实世界的货币价值。它们不能在平台外交换、出售或转换为现金。
  • 最终销售且不退款:通过应用程序进行的所有购买都是最终且不可逆转的。 MinglePub 不提供 Apple App Store 或 Google Play Store 自己的消费者退款政策之外的直接现金退款。
  • 如果您的账户因违反使用条款而被永久关闭，您现有的余额、钻石和 VIP 会员天数将被重置，并且您不得要求任何金钱赔偿。
  • Payment Processing via Whop: Purchases made through our website are processed by Whop, Inc., an independent third-party payment processor. By completing such a purchase, you also agree to Whop's own Terms of Service and Privacy Policy, which govern the payment transaction itself.
  • Chargebacks and Payment Disputes: If you initiate a chargeback or payment dispute with your bank or payment provider without first contacting MinglePub support, your account may be immediately suspended pending investigation. MinglePub may submit evidence of your account activity to the payment processor or your bank to contest the dispute.
  • Pricing Changes: MinglePub reserves the right to change the pricing of virtual currencies, packages, or VIP membership plans at any time. Material pricing changes will be announced in-app before taking effect and will not retroactively affect balances you already own.

8. App Store 和 Google Play 免责声明

如果您通过 Apple App Store 或 Google Play Store（“应用商店”）下载应用程序，则您承认本协议仅在您和 MinglePub 之间生效；并且应用商店不对应用程序的内容、维护或支持服务负责。

9. 免责声明和责任限制

该平台“按原样”和“可用”提供其服务。不保证连接不间断、无病毒、无错误或完全安全（包括互联网服务提供商断开连接）。 MinglePub 不会验证与您匹配的其他用户的行为、历史记录或身份。 MinglePub 不能对因用户在平台上的对话、彼此共享的个人信息或决定在平台外见面而造成的任何身体、物质或精神损害负责。您对与您交往的人的安全负有责任。

10. 争议解决和管辖

本协议的解释和适用中可能产生的任何争议，适用 MinglePub 法人正式注册地国家/商务中心的法律。发生任何争议时，相关主管法院、调解员和执行机构具有管辖权。

AI Live Translation

Calls between members who speak different languages may use real-time AI voice translation powered by third-party AI services (Google Gemini). Translations are generated automatically and may contain errors or inaccuracies; MinglePub does not guarantee the accuracy of any translation and is not liable for misunderstandings arising from translated content. By using the translation feature you agree that your call audio is processed by the third-party AI service as described in our Privacy Policy. You may disable translation at any time during a call.

11. 变更及联系

MinglePub 保留随时更改本协议条款的权利，恕不另行通知。系统架构、新功能或法律要求可能会导致更改。当前版本的协议一经上传至平台即生效，您继续使用平台即表示您已自动阅读并接受变更内容。
